En la provincia de San Luis, la justicia declaró inconstitucional la interrupción voluntaria del embarazo en la provincia luego de la presentación realizada por la exsenadora nacional Liliana Negre, fervierte opositora al aborto legal.
Fuentes judiciales señalaron que la jueza laboral 2 María Eugenia Bona declaró la vigencia del artículo 19 del Código Civil y Comercial “que reconoce la existencia de la persona humana desde la concepción”, declaró la “inconstitucionalidad” y “la inconvencionalidad” de los artículos 4 apartado 1 y 2, y apartados a, b y c, de la ley nacional 27.610 que autoriza la interrupción voluntaria del embarazo.
A su vez, el dictamen señala que el “artículo 27 de la Convención de Viena, artículos 1 y 4 de la Convención de los Derechos Humanos, (Pacto de San José de Costa Rica), artículo 1, 2 y 3 CDN, artículo 75 inciso 22 CN, artículos 49 y 210 Constitución de la Provincia de San Luis y jurisprudencia citada, artículo 75 inciso 23 CN”.
La medida surge luego de que la exsenadora Liliana Negre de Alonso presentara una declaración de certeza para que “cese el estado de incertidumbre en el ámbito provincial” que ocasiona la “contradicción” entre dos artículos de la ley del aborto legal, y el artículo 19 de Código Civil y Comercial, y de esta forma se prohíba en San Luis “la práctica quirúrgica, clínica o medicamentosa del aborto, salvo en las causales contempladas en los incisos a (embarazo resultado de una violación) y b (peligro la vida o la salud integral de la persona gestante) del artículo 4 de la Ley 27.610.
